1. Personal data

Edelweiss Bike Travel Reisegesellschaft m.b.H. collects, processes and uses your personal data only with your consent or to fulfil the contract for the purposes agreed with you or if there is another legal basis in accordance with the GDPR, this while complying with provisions re-lating to data protection and civil law.

Only personal data which is necessary for executing and processing the ordered services or data which has been provided voluntarily by you to us will be collected.

Personal data is all data that contains individual details on personal or factual circumstances of the users, such as for example name, address, E-mail address, telephone number, date of birth. In exceptional cases, sensitive data such as health data may also be covered.

2. Access and erasure

As customer or, respectively, in general as person concerned you have at any time the right to obtain information on the personal data stored about you, its origin and recipient and the purpose of data processing as well as the right to rectification, data transmission, objection, limitation of the processing as well as blocking or erasure of incorrect data or, respectively, of data that has been processed unlawfully.

If your personal data changes, please notify us thereof.

You have at any time the right to withdraw your consent to your personal data being used. Your petition to access, erasure, rectification, objection and/or data transmission in the latter case, unless this requires a disproportionate effort, may be directed to the address of Edelweiß Bike Travel Reisegesellschaft m.b.H. mentioned in the last clause of this declaration.

If you think that the processing of your personal data by us violates applicable data protection law or that your claims under data protection law have been violated in another way, there is the possibility of complaining to the competent regulatory authority. In Austria, the data protec-tion authority is competent.

3. Data security

Your personal data is protected by respective organisational and technical measures. These measures concern in particular the protection against unauthorised, illegal or also random ac-cess, processing, loss, use and manipulation.

Notwithstanding efforts taken to comply with an at all times reasonably high level of due dili-gence, it cannot be ruled out that information made available by you to us via the Internet is seen and used by other persons.

Please note that we therefore do not assume liability in any way for the disclosure of infor-mation due to errors during data transfer and/or unauthorised access by third parties (e.g. a hacker attack on E-mail account or, respectively, telephone) not caused by us.

4. Use of data

We will process the data provided to us for no other purposes than the purposes covered by the contract or by your consent or by any other provision in accordance with the GDPR. The use for statistical purposes, provided that the data made available has been anonymized, shall be excluded therefrom.

5. Transmission of data to third parties

In order to fulfil your contract, it may also be necessary to transmit your data to third parties (e.g. hotel, motorbike rental services, travel agency, travel insurance or other service providers we use). Your data will be transmitted solely on the basis of the GDPR, in particular to fulfil your contract or based on your prior consent.

Some of the recipients of your personal data mentioned above are located outside your country or process your data there. It may be the case that the data protection level does not corre-spond to the one practised in Austria. However, we only transmit your personal data to coun-tries the data protection level of which the EU Commission has deemed appropriate by means of a decision or we take measures to ensure that all recipients dispose of an appropriate data protection level for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. Reporting of data leaks

We take care to ensure that data leaks are detected at an early stage and, where applicable, reported immediately to you or, respectively, to the respective regulatory authority taking into account the respective data categories concerned.

7. Storage of data

We will not store data for longer than is necessary to fulfil our contractual or, respectively, legal obligations and to defend ourselves from any claims.

9. Newsletter

Newsletters will only be sent if you register for the newsletter reception on our website. For this, the E-mail address as well as the name and the declaration of your consent to receiving the newsletter are needed. As soon as you have subscribed to the newsletter, a confirmation E-mail containing a link with which you can confirm the subscription will be sent. The newsletter subscription can be cancelled at any time. For this, you only have to click on the unsubscription link contained in each of our newsletters. Then, you will be re-directed to our website where you can easily unsubscribe. Thereupon, all data in connection with sending the newsletter will be erased.

10. Online forms

Unfortunately, we cannot assume any liability for the security of the data transmission on the Internet. In particular when transmitting data in an unencrypted form via the HTTP protocol or via E-mail, there is the danger that the data is accessed by third parties. Personal data sent to us via online forms, for example newsletter subscriptions, booking forms or other contact re-quests, are to be deemed as potentially insecure from a technical point of view. Of course, we will take all technical and organisational measures to secure this data and not to make them available to third parties. However, full data security cannot be ensured by us when communi-cating via an unencrypted transmission channel.

11. Conversion tracking by means of FACEBOOK's visitor action pixels

Upon consent by the user, we use the “visitor action pixel” of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) on our website. With its help, we can track the actions of users after they have looked at a Facebook advertisement or clicked on such. In this way, we can record the effectiveness of Facebook advertisements for statistical purposes and purposes related to market research. The data collected this way is anonymized, this means that we do not see the personal data of individual users. However, this data is stored and processed by Facebook about which we will inform the user according to our state of knowledge. Facebook may associate this data with the Facebook account and also use it for its own advertisement purposes in accordance with Facebook’s Data Policy: https://www.face-book.com/about/privacy/. The user may enable Facebook and its partners to place advertise-ments on and outside of Facebook. For these purposes, a cookie may also be stored on the respective computer. Alternatively, the settings may be adjusted and deactivated under https://www.facebook.com/settings/?tab=ads. However, to do this, the user has to be logged into Facebook.

12. Use of cookies

When users access the website, one or several cookies will be stored on their computer. A cookie is a small file which contains a certain sequence of characters and unambiguously identifies the browser of the user. By means of cookies, the provider improves the convenience and quality of its services, for example by saving user settings. By using cookies, the use is significantly facilitated since a computer will be recognized when visiting the website again and therefore, repeated data input becomes easier. Our cookies help determine the frequency of use and number of users on our website. Cookies do not cause any harm to the computer of the user and do not contain viruses. It is also possible to use the website without cookies. However, these have to be accepted in order to carry out a booking. In their browser users can deactivate the storage of cookies, restrict the storage of cookies to certain websites or set their browser up in such a way that it informs them before a cookie is stored. The user can delete cookies at any time from the hard drive of his computer via the data protection functions of his browser. In this case, the functions and the user friendliness of the website may be restricted.

13. Use of GOOGLE ANALYTICS

We use Google Analytics, a web analytics service offered by Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files which are stored on the computer of the users and which enable an analysis of their use of the website. The information on the use of this website generated by the cookie is, in general, sent to a Google server located in the USA and is stored there. However, in case IP anonymization is activated on this website, the IP address of the users will be shortened beforehand by Google within the member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in ex-ceptional cases will the full IP address be sent to a Google server in the USA and shortened there. IP anonymization is active on this website. On behalf of the website operator, Google will use this information to analyse the use of the website in order to draw up reports on website activities and to provide further services to the website operator related to the use of the web-site and of the Internet. Google will transfer this information only to third parties insofar as this is required by law or insofar as third parties process this data on behalf of Google. The IP address transmitted by Google Analytics will not be merged with other data of Google. Users can configure their browser software in such a way that cookies are not stored. However, we would like to point out that it may be possible that not all functions of this website can be used to their full extent thereafter.
